On the 3rd of January the 3rd, 2019 her nomination was returned to the President in accordance with Rule XXXI Paragraph 6 of the United States Senate. On January 23, 2019 the President Trump declared his intention to nominate Berger to the federal judgeship. Her nomination was then sent to the Senate on the same day. On February 7, 2019 her nomination was voted out of committee with a vote of 12-10. On July 24, 2019 the Senate called for cloture to her nomination in 55-37 votes. The nomination was later confirmed on that same day, with the Senate by a 54-37 vote. The judicial commission received her nomination on the 29th of July, 2019.
Berger was among four names submitted for senators Marco Rubio and Bill Nelson. On April 10, 2018 President Trump announced the nomination of Berger to be the United States District Judge of the United States District Court for the Middle District of Florida. The nomination was made to the vacant seat of the Judge John E. Steele, who was elevated to senior status on June 3 of 2015. In her time as a circuit judge, Berger presided over the divisions of probate and civil (2005-2006) as well as the adult criminal division (2006-2012) within St. Augustine. She also served as the presiding over the St. Johns County Adult Drug Court Program (2005-2012). The 21st of August, 2012 Gov. Rick Scott appointed Berger to the Fifth District Court of Appeal. In 2016 she was among three candidates for a position on the Supreme Court of Florida.
